Today we’re going to talk about what you need to do if you’re served with a Summons and complaint. Many times when we speak to people the first thing they want to do is call the attorneys for the Creditor to find out what to do, or see if they can resolve the issue without the lawsuit moving forward. And we really urge people to refrain from doing that, because you have to remember that the attorneys you are contacting represent the Creditor and they don’t have your best interest at heart. Many times when you call a collection law firm you’re going to be dealing with a collection agent not an attorney. You may get incorrect information about the lawsuit, what your rights are, and many times people enter into arrangements that fail to take into account any defenses that you may have and they also cause you to pay more money than you would have.

We want to make sure that when you’re sued, that you are advised of the procedures of the lawsuit, investigate things such as the underlying debt, the right of the Creditor has to collect a judgement against you, and look into things such as your finances and other hardships you may have, so we can negotiate a settlement or even fight the debt in its entirety to your best advantage.
