What Is A Frozen Bank Account?

A restrained or “frozen” bank account is a bank account that you cannot take money from because a creditor has directed the bank to hold your money for collection purposes.  When your bank account is frozen, you can put money into it, but you can’t take money out.

Why Is My Bank Account Frozen In The First Place?

How Does The Process Work?

Generally speaking, a creditor must first file a lawsuit against you and obtain a judgment from the Court in order to freeze your bank account.  They then locate your bank and send a notice along to restrain the account.

Once your bank account is frozen, your bank is required to send you a form, within two (2) days, instructing you on how to proceed in different scenarios (including when you believe that none of the money in your account should be subjected to the freeze).
